Проблеми правого захисту педагогічної діяльності шкільного вчителя фізичної культури

Дослідження даної статті було спрямовано на пошук доказів які спроможні довести непричетність вчителів фізичної культури до отриманих травм на своєму уроку під час невдалого виконання фізичних вправ учнями. За час ретельного вивчення літературних джерел, встановлено, що травми, яких було отримано під час виконання фізичних вправ стаються за рахунок порушення аферентації зворотного зв’язку у внутрішньо мозкових центрах тих осіб які їх виконували, а не за рахунок недбальства вчителів. Вивчаючи послідовність логіки травмування одночасно з внутрішнім механізмом помилки, виявлено, що ні серед послідовної логіки, ні серед складових помилки, яка є попередницею травми, не існує слідів або доказів які свідчать про причетність вчителів фізичної культури до отриманих травмувань. Аналізуючи існуючий закон з охорони праці (ОП) виявлено, що його не можна використовувати у стані на зараз в напрямку галузі фізичного виховання, оскільки статті і основні положення чинного закону спрямовані на порушення техніки безпеки у технічно індустріальних галузях, а уроку фізичної культури у загальноосвітній школі належить до діяльнісної галузі, навчальні процеси якої є повністю протилежними технологічним процесам на виробництвах, тому даний закон потребує перегляду. Підсумок аналізу характеристики трудового процесу вчителів фізичної культури свідчить, що враховуючи данні санітарних норм гігієнічної класифікації праці, державі добре відомі труднощі даної категорії вчителів, але вони поки що залишаються серед наукових звітів через відсутність правового захисту.

The research of this article was aimed at finding evidence that could prove the non-involvement of physical education teachers in injuries received in their lesson during unsuccessful performance of physical exercises by students. During a thorough study of literary sources, it was established that injuries received during physical exercises occur due to a violation of feedback afferentation in the intra-brain centers of those who performed them, and not due to the negligence of teachers. Studying the sequence of the logic of injury simultaneously with the internal mechanism of error, it was found that neither among the sequential logic nor among the components of the error that is the predecessor of the injury, there are no traces or evidence indicating the involvement of physical education teachers in the injuries received. Analyzing the existing law on labor protection (OP), it was found that it cannot be used in its current state in the direction of the field of physical education, since the articles and main provisions of the current law are aimed at violating safety regulations in technical and industrial industries, and the physical education lesson in a general education school belongs to an activity field whose educational processes are completely opposite to technological processes in production, therefore this law needs to be revised. The safety regulations and job descriptions for physical education teachers do not take into account the specifics of the subject of physical education, so the narrowly specific nature of professional work is ignored, scientific achievements, not only of past but also of modern years, remain unnoticed, and no attention is paid to the rapid growth of the weight of the general education load, and this significantly makes the teaching process impossible due to the high criminal liability. The result of the analysis of the characteristics of the labor process of physical education teachers shows that, taking into account the data of the sanitary norms of the hygienic classification of labor, the state is well aware of the difficulties of this category of teachers, but they still remain among scientific reports due to the lack of legal protection. At the same time, the indicator of emotional stress, combining the degree of responsibility for the result of their activities with the degree of responsibility for safety, forces physical education teachers to be afraid of their own lessons, makes their work inert as a result of lack of confidence in their actions, and this often forces the educational process to be formal.
