Феноменологічні, методологічні та практичні основи правової експертизи юридичних документів

Дисертаційна робота присвячена комплексному дослідженню питань феноменології, методології та практики правової експертизи юридичних документів. В роботі автором вивчаються питання загальнотеоретичного, методологічного та практичного значення щодо історії становлення і розвитку правової експертизи як практичної діяльності та як об’єкта наукового дослідження, з’ясовується сутність та зміст правової експертизи юридичних документів, аналізуються принципи її здійснення та функціональне призначення; досліджуються питання об’єкта та суб’єктів правової експертизи, виокремлюються стадії її здійснення. Окрім того автором вивчаються питання статусу висновків правової експертизи юридичних документів, тенденції та проблеми розвитку правової експертизи в Україні. Автором надано ряд авторських визначень таким поняттям як „правова експертиза”, „принципи правової експертизи”, „функції правової експертизи”, „об’єкт правової експертизи” тощо. На підставі узагальнення поглядів вчених на проблематику сутності та здійснення правової експертизи юридичних документів в дисертації обґрунтовано зміст правової експертизи юридичних документів, проведено узагальнення стану та тенденцій розвитку правової експертизи юридичних документів в Україні, зроблено ряд висновків щодо вдосконалення методики і практики здійснення правової експертизи.

The thesis covers the comprehensive research of the issue of the phenomenological, methodological and practical principles of the legal instruments lawful expertise. In this research paper the author studies the issue of the general theoretical, methodological and practical importance of the history of establishment and development of the lawful expertise as a practical activity and as the object of the scientific research; clarifies the essence and the contents of the legal instruments lawful expertise; analyzes the principles of its fulfillment and functional purpose; researches the issue of the object and the subjects of the lawful expertise and determines the stages of its fulfillment. Besides, the author studies the status of the conclusions of legal documents lawful expertise, the tendency and the problem of the lawful expertise in Ukraine. The author provides the set of own definitions of such notions as „lawful expertise”, „principle of lawful expertise”, „functions of lawful expertise ”, „object of lawful expertise”, etc. On the basis of the scientists’ views generalization on the problematic of the essence and fulfillment of the legal instruments lawful expertise, this thesis grounds the contents of the legal instruments lawful expertise, it carries out the generalization of the state and development tendencies of the legal instruments lawful expertise in Ukraine, draws the set of conclusions concerning the improvement of the methods and practice of the lawful expertise fulfillment.
