Медичне страхування у загальній системі страхування: правовий вимір

Статю присвячено аналізу правових аспектів медичного страхування у загальній системі страхування. Акцентовано увагу на спільних рисах та відмінностях соціального страхування та медичного страхування. Зазначено, що в Україні назріла необхідність запровадження обов’язкового медичного страхування.

Статья посвящена анализу правовых аспектов медицинского страхования в общей системе страхования. Акцентировано внимание на общих чертах и различиях социального страхования и медицинского страхования. Отмечено, что в Украине назрела необходимость введения обязательного медицинского страхования.

The article is devoted to analysis pravovyye health insurance in the overall insurance system. The attention is focused on the similarities and the differences Strahuvannya social health insurance. If we analyze the scientific theoretical developments in the field of insurance, it can be concluded that there is also no consensus about what to consider insurance: way, form, method, controller, a set of measures, relations of protection and the like. Insurance – it is the totality of legal norms regulating public relations arising in the process of ensuring insurance protection of property interests physical and legal persons, is the most correct.
Social insurance is a component of the social security system, i.e. the system of legal, economic and organizational measures aimed to compensate or minimize the consequences of the changes of material (social) position as a result of the occurrence of circumstances which are determined by the state socially significant, in order to equalize the social status of this man in comparison with other members of society. Social insurance as a legal category, according to the author, can be defined as the set of legal rules governing social relations on the social security of a person when the insured event occurs (socially significant facts) at the expense of the insurance funds. It is noted that in Ukraine there is a necessity of introduction of obligatory medical insurance.
