Міжнародні стандарти захисту прав людини в культурній дипломатії

Abstract

Метою роботи є аналіз механізмів інтеграції міжнародних стандартів захисту прав людини у сфері культурної дипломатії, зокрема шляхом розкриття її інституційних, правових і культурних аспектів у міжнародному та національному контекстах. У дослідженні використано комплекс методів, які забезпечили міждисциплінарний підхід до вивчення культурної дипломатії як правозахисного інструменту в контексті міжнародного права та гуманітарної політики: загальнонаукові методи аналізу та синтезу – для системного вивчення понять культурної дипломатії, м’якої сили, гуманітарної політики та міжнародних прав людини; індукції та дедукції – для переходу від конкретних кейсів культурної дипломатії окремих країн до узагальнення закономірностей її правозахисної функції. Наукова новизна дослідження полягає в концептуалізації культурної дипломатії не лише як інструменту зовнішньополітичної стратегії чи м’якої сили, а як форми гуманітарної правозахисної діяльності, що функціонує в рамках міжнародного права та глобального публічного простору; уперше здійснено порівняльний аналіз практик Канади, Швеції, Японії та Франції як країн, що реалізують культурну дипломатію на засадах міжнародних правозахисних стандартів. У результаті проведеного дослідження було досягнуто поставлені цілі та виконано основні завдання, що дозволяє сформулювати такі висновки: 1. Проаналізовано еволюцію поняття культурної дипломатії як складника гуманітарної та зовнішньої політики. 2. Узагальнено наукові визначення терміна «культурна дипломатія», що охоплюють інструментальні, комунікативні та символічні моделі. На основі існуючих підходів сформульовано авторське визначення культурної дипломатії. 3. Досліджено нормативно-правові основи культурної дипломатії. 4. Проаналізовано функціональні механізми реалізації прав людини через культурну дипломатію. 5. Здійснено порівняльний аналіз практик Канади, Швеції, Японії та Франції. 6. Виявлено основні виклики для ефективної культурної дипломатії.The aim of the work is to analyze the mechanisms of integration of international standards of human rights protection into the sphere of cultural diplomacy, in particular by revealing its institutional, legal and cultural aspects in international and national contexts. The study used a set of methods that provided an interdisciplinary approach to the study of cultural diplomacy as a human rights protection tool in the context of international law and humanitarian policy: general scientific methods of analysis and synthesis – for a systematic study of the concepts of cultural diplomacy, soft power, humanitarian policy and international human rights; induction and deduction – for the transition from specific cases of cultural diplomacy of individual countries to the generalization of the regularities of its human rights protection function. The scientific novelty of the study lies in the conceptualization of cultural diplomacy not only as an instrument of foreign policy strategy or soft power, but as a form of humanitarian human rights protection activity that operates within the framework of international law and the global public space; For the first time, a comparative analysis of the practices of Canada, Sweden, Japan and France as countries implementing cultural diplomacy on the basis of international human rights standards was carried out. As a result of the research, the set goals were achieved and the main tasks were fulfilled, which allows us to formulate the following conclusions: 1. The evolution of the concept of cultural diplomacy as a component of humanitarian and foreign policy was analyzed. 2. Scientific definitions of the term “cultural diplomacy” were generalized, covering instrumental, communicative and symbolic models. Based on existing approaches, the author’s definition of cultural diplomacy was formulated. 3. The regulatory and legal foundations of cultural diplomacy were studied. 4. The functional mechanisms for the implementation of human rights through cultural diplomacy were analyzed. 5. A comparative analysis of the practices of Canada, Sweden, Japan and France was carried out. 6. The main challenges for effective cultural diplomacy were identified.
