The article is devoted to the study of constitutional resilience as one of the key characteristics of modern democratic constitutionalism under conditions of martial law and large-scale security challenges. The relevance of the research is determined by the unprecedented challenges faced by Ukraine as a result of the full-scale armed aggression of the Russian Federation, which has necessitated the adaptation of constitutional institutions and mechanisms while preserving the democratic nature of the constitutional order. The study examines the theoretical foundations of constitutional resilience and analyses its relationship with the concepts of constitutional stability, constitutionalism, and the rule of law. It is argued that constitutional resilience should not be understood merely as the preservation of existing constitutional institutions but rather as the ability of a constitutional system to adapt to extraordinary circumstances without losing its fundamental values, principles, and institutional foundations. In this regard, constitutional resilience is viewed as a mechanism that enables a democratic state to combine flexibility in responding to crises with the preservation of constitutional legitimacy. Particular attention is paid to the limits of constitutional transformation under martial law. The article substantiates that not every institutional or legal change caused by wartime necessity can be regarded as a manifestation of constitutional resilience. The boundaries of constitutionally permissible adaptation are determined by constitutional legitimacy, the principle of proportionality, the temporary nature of extraordinary restrictions, and the inviolability of the constitutional core of a democratic state based on democracy, the rule of law, separation of powers, human dignity, and fundamental rights. The Ukrainian experience after 24 February 2022 is analysed as a practical example of constitutional resilience in action. Despite the unprecedented scale of military threats, Ukraine has maintained the operation of its constitutional institutions, ensured the continuity of public authority, preserved the functioning of parliament, government, local self-government and the judiciary, and upheld the constitutional framework for the protection of human rights under martial law. This experience demonstrates that constitutional resilience constitutes an important factor in preserving statehood, democratic legitimacy, and constitutional continuity during periods of existential threat. The article also emphasises that the significance of constitutional resilience extends beyond wartime governance. It serves as an essential foundation for post-war recovery, institutional reform, and Ukraine’s further integration into the European legal and political space. The ability to modernise state institutions while maintaining commitment to democratic constitutional values is considered a prerequisite for sustainable democratic development. The scientific novelty of the research lies in substantiating the thesis that constitutional resilience should be regarded as an independent constitutional category that determines the limits of transformation of the democratic constitutional order under conditions of extraordinary threats and ensures the preservation of constitutional continuity, democratic legitimacy, and the rule of law.
