Історичний розвиток інституту банкрутства

Розглянуто становлення і розвиток інституту неспроможності і взаємовідносини
пов’язані з неповерненням боргів в деяких зарубіжних державах. Початок розвитку інституту
характеризувався переважно каральними заходами відносно боржника. Згодом залежно від
наявності в діях боржника провини, почалась диференціація особистої відповідальності
боржника і його майнової відповідальності.

Becoming and development of institute of the insolvency andmutual relations, related to by a
nonredemption of debts in someforeign states, is considered. Beginning of development of institute of
insolvency was characterized by mainly punitive measures in regard to a debtor. Afterwards, depending
on a presence in the actions of debtor of guilt, differentiation of the personal responsibility of debtor and
his property responsibility began.
