Права дітей з обмеженими можливостями: теоретико-правовий аналіз

Abstract

Дисертація присвячена комплексному науково-теоретичному дослідженню прав дітей з обмеженими можливостями, в ході якого висвітлено історіографію проблеми та методологію дослідження прав дітей з обмеженими можливостями. Запропоновано авторське визначення поняття „дитина з обмеженими можливостями”. У роботі досліджуються еволюція прав дітей з обмеженими можливостями та розглянуто права дітей-інвалідів з позиції поділу їх на загальні (які належать усім дітям) та спеціальні (які належать лише дітям з обмеженими можливостями). Розроблено механізм забезпечення прав дітей з обмеженими можливостями та визначено основні критерії виміру його дієвості. Обґрунтовано потребу зміни пануючої в державі та суспільстві концепції інвалідності, яка повинна включати медичний, економічний і соціальний підходи до інвалідності дітей.Dissertation is devoted to a complex scientific and theoretical research of rights of children with disabilitiеs, during which historiography of problem and methodology of research of rights of children with disabilitiеs are reflected. Author determination of concept „child with disabilitiеs” is offered. In-process probed evolution of rights of children with disabilitiеs and rights of children with disabilitiеs are considered from position of division them on general (what belong to all children) and special (what belong only to children with disabilitiеs). The mechanism of providing of rights of children with disabilitiеs and certainly basic criteria of measuring of his effectiveness are developed. Grounded requirement of change 23 dominating in the state and society of conception of disability, which must plug medical, economic and social approaches in disability of children are given.
