The article is devoted to the study of the nature of international legal mechanisms for redressing harm caused by inter-State conflicts, as well as to clarifying the place of reparations, compensation, and restitution within the system of international legal responsibility of States. It is substantiated that the effectiveness of these mechanisms is determined by their ability to ensure the restoration of violated rights, compensation for damages incurred, and the implementation of the principle of international justice. The main scientific approaches of foreign and domestic scholars to defining the legal nature of reparations, compensation, and restitution are analyzed; their common and distinctive features, functional purpose, and specifics of application in international legal practice are revealed. Particular attention is paid to the interrelationship of these categories as interconnected elements of a single mechanism for redressing harm, which is implemented in the event of an internationally wrongful act committed by a State. It is established that reparations are comprehensive in nature, compensation aims at monetary or material redress for losses, while restitution entails restoring the situation that existed prior to the violation (status quo ante). In this context, the judgment of the Permanent Court of International Justice in the Factory at Chorzów case (1928), which established the conceptual foundations for the modern understanding of restitution, is analyzed.
It is concluded that modern mechanisms for redressing harm combine normative, institutional, economic, and humanitarian components. In the context of the Russo-Ukrainian War, their practical significance increases substantially, as they form the foundation for holding the aggressor State accountable, restoring violated rights, ensuring the post-war reconstruction of Ukraine, and strengthening the international legal order.
